F Bombing Truck Driver Given Court Appearance Notice.

“Is today the third (of January) awe f%%k,” a surprised Robert Baillie told Moose Jaw Provincial Court when the clerk got ahold of the truck driver by telephone.

Baillie was appearing by telephone facing theft related offences.

Baillie is charged allegedly breaching the following sections of the Criminal Code of Canada:

Section 266 - Assault

Section 334 (four counts) - Theft Under $5,000

Section 355 - Possession of Stolen Property Greater Than $5,000

No details of the offense were publicly discussed in Court but Judge Daryl Rayner told Baillie his case had been going on for some time and needed to proceed.

“This has been going on for a considerable amount of time,” Judge Rayner told the accused.

Baillie said he had tried to get ahold of Crown Prosecutor Rob Parker the previous Friday on order to discuss his case but had been unable to do so.

Judge Rayner replied he needed the accused to be in court at his next appearance in two and ordered him to do so.

“I can make arrangements to be in Moose Jaw and deal with these matters,” Baillie said, adding “no problem I can make it work.”

Judge Rayner set a next appearance date for Baillie to January 17th although the Judge did not appear happy about it.

“You are fortunate I did not issue a warrant today,” Judge Rayner said.

As with all defendents facing criminal charges the accused is to be considered not guilty until proven so in a court of law.

CORRECTION - We were contacted by the accused as well as a friend who stated Baillie had never been charged with possessing a weapon as published earlier.

An attempt was made to contact Mr Baillie whose return email address was not valid to answer his concerns.

We checked with the Provincial Court - twice (fourth time in total) - who found the error in what was originally released.

As such we have updated the story to eliminate the error.
