Accused Gets A Lawyer And A Court Date
An accused who self represented himself at Moose Jaw Provincial Court on Monday morning left with two things - an adjournment and a Legal Aid lawyer.
Appearing on his own behalf Kyle Hoffos was facing an assault with the intent to steal property.
“It’s essentially a robbery charge,” Judge Daryl Rayner told the accused.
Asked how the Crown was proceeding Prosecutor Rob Parker said indictable.
The Crown can elect to proceed on a case either through summary or indictable offense.
Proceeding as a indictable offense indicates the Crown is seeking a higher punishment which can include a prison sentence.
Hoffos indicated he did not know how to proceed with Judge Rayner telling the accused “you need to get the process underway.”
The Judge told Hoffos that Legal Aid would consider representing him “due to the serious nature of the charge “
Judge Rayner adjourned the case until February 1, 2023 to allow Hoffos to apply for Legal Aid.
After leaving the Court he later returned with Legal Aid lawyer Suzanne Jeanson who said he did qualify for Legal Aid.
It needs to be noted Hoffos is to be considered innocent until proven guilty on a court of law.
